Rules for Installation of Satellite Dishes

WHEREAS, Section 6 of the Declaration of Partridge Berry Hills Condominium requires all owners to obtain prior written consent of the Board of Directors for alterations and modifications of the Common areas of the Condominium, and

WHEREAS, the Federal Communications Commission ('the FCC") adopted a rule effective October 14, 1996, pertaining to the installation, maintenance, and use of direct broadcast satellite, television broadcast, and multipoint distribution service antenna ("antennas"); and

WHEREAS, the Association desires and intends to adopt reasonable restrictions governing installation, maintenance, and use of satellite dishes in the best interest of the Association and consistent with the FCC rule,

NOW, THEREFORE, the following restrictions and regulations for the Association shall be binding upon all owners and their grantees, lessees, tenants, occupants, successors, heirs, and assigns who currently or in the future may posses an interest in the Partridge Berry Hills Condominium Association:

1.

Satellite dishes shall be mounted to a 2" PVC (schedule 40) pipe in the color gray, white, or black.

2.

The pipe shall be attached to the inside corner of the wrought iron railing of the unit with radiator clamps.

3.

No penetrations of the floorboards, walls, soffit, roofs, or any other area or unit area may be made.

4.

The satellite dish shall be mounted on the top of the pipe and shall not extend up to or touch the soffit on 2nd floor units of the above deck on ground floor units.

5.

The wire from the satellite dish shall be run inside the 2" PVC pipe. A hole shall be made in the pipe at the top to allow the coaxial wire from the dish to enter. A second exit hole shall be made in the 2" PVC pipe at the height of the railing to allow the exit of the coaxial wire.

6.

The wire shall be run along the wrought iron railing towards the unit and may be snugly attached with black plastic tie wraps. The wire shall then extend up the corner of the slider frame and make a 90 degree angle towards the in-wall air conditioning unit. The coaxial cable shall then enter the unit through the sleeve for the air conditioning unit.

7.

There shall be no hanging or exposed wires.

8.

The satellite dish shall not exceed 18" in diameter.

9.

Satellite dishes not installed in accordance with these specifications will be removed at the expense of the owner of the respective unit. Expense to remove satellite dishes not in compliance will include restoration of damage caused to the building and common areas by the installation.

10.

Residents who are not the owner of the unit may not install any satellite dish without the written permission of the owner.

11.

Owners who install antenna are responsible for all costs associated with the installation and maintenance of the antenna, including by not limited to costs for:

  • repairs for damage to any property caused by the installation or maintenance of the antenna.
  • payment of medical expenses incurred by any person(s) injured by the antenna installation, maintenance, or use.
  • restoration of installation sites to their original condition upon removal of the antenna.

12.

If a satellite dish becomes detached, the owner has seventy-two (72) hours to reattach or remove the antenna. If the detachment poses a safety hazard to others, and the owner has not taken appropriate action, the Board of Directors may have the antenna removed at the respective owner's expense.

13.

Increased common area maintenance costs caused by the installation of a satellite dish will be borne by the owner of the satellite dish.

14.

If maintenance requires the temporary removal of the satellite dish, the Association will provide the owner a three (3) day written notice. Owners will be responsible for removing and reattaching the satellite dish at their own expense. If the satellite dish is not removed before the required maintenance begins, the Association will direct the removal at the respective owner's expense. The Association will not be responsible for any damage to the satellite dish caused by Association removal.

15.

When an owner sells the unit, the satellite dish must be removed unless the new owner accepts, in writing, responsibility for the satellite dish.

16.

Requests for variances of the aforementioned stipulations, rules, and guidelines shall be made in writing to the Board of Directors. A decision on any written request shall be rendered by the Board and the requestor shall be notified of the Board's decision in writing.

17.

Installation of a satellite dish shall signify the acceptance of all the conditions and stipulations as outlined herein.

This Policy takes effect beginning November 1, 2000.
