POLICY RESOLUTION #XVI

Relating to Assessments for Violation of Declaration, Bylaws, Resolutions and Rules of the condominium, and orientation of new unit owners and tenants.

WHEREAS Article II, Section 7, gives the Board powers and duties conferred upon it by the State Statutes, Declarations, Bylaws, and all other powers necessary for administration of the affairs of the condominium; and

WHEREAS the enforcement of Rules, Declarations, Bylaws, and Resolutions of the condominium are intended to contribute to preserving the environment and assuring peaceful enjoyment of the condominium, to protect and, enhance the value therein, and to not unduly restrict or burden the use of the property; and

WHEREAS numerous violations of the Rules, Declarations, Bylaws and Resolutions of the condominium have continued in spite of numerous warnings, to the detriment of the environment, the peaceable enjoyment of unit owners, the legal operation of the condominium and an excessive burden on the use and maintenance of the property,

NOW, THEREFORE, BE IT RESOLVED THAT the Managing Agent, in accordance with #22 of the recorded rules of the condominium, and Article II, Section 7(e) of the Bylaws, is hereby delegated the authority and shall enforce the following costs, assessments and rules, all of which are subject to his receiving a signed, written identification of the violation from a unit owner. The Managing Agent or his employees may also file a signed written notice of violation. The enforcement of all items herewith are subject to Policy Resolution IV.

VIOLATIONS UNDER POLICY RESOLUTION XIII, PET RULES

First Violation

$10.00, plus costs

Second Violation

$25.00, plus costs

Third Violation

48 Hours Notice of Removal

If pet is not removed in 48 hours, the assessment is $100.00.

The M.A. shall, at his discretion, reinstitute the First Violational Penalty.

The latter two violations are in conformance to the Resolution.

VIOLATION OF ARTICLE V, SECTION 4 OF THE BYLAWS WAIVER OF LIEN

There shall be a charge of $10.00 to provide unit owners selling their unit with a Waiver of Lien required by Chapter 356B, State of New Hampshire. Failure to apply for said lien waiver - $100.00 plus costs.

VIOLATIONS OF ARTICLE VI, SECTIONS 1, 2 & 3 RIGHT OF FIRST REFUSAL

Unit owners selling or renting a unit shall be charged $10.00 for a Right of Refusal Waiver Failure to apply for said waiver of Right of First Refusal - $100.00, plus costs.

And further, be it resolvedthat.all unit owners selling or renting their units shall cause prospective buyer or tenant to undergo an orientation meeting with the Managing Agent or person or persons selected by the Board prior to occupancy of the unit and receipt of the Waiver of Liens and Right of First Refusal. Said orientation shall take place between 8:30 A.M. and 5:00 P.M. Monday thru Friday by appointment with the Managing Agent or at some time or place which is mutually convenient. A charge of $15.00 shall be paid by the unit owner to the condominium. Failure to attend an orientation interview shall result in a $50.00 assessment.

All assessments and fees shall be paid within 25 days of the billing by the condominium. Any assessment or fee that remains unpaid shall further be assessed a late charge of $5.00 for each month in which the fine remains unpaid 25 days after the billing.

And further be it resolved that the Managing Agent shall be compensated for his costs by the condominium in the amount of $10.00 for each violation letter sent under this resolution, $10.00 for each Lien Waiver, $10.00 for each waiver of Right of First Refusals, and $15.00 for each orientation.

The effective date of this resolution shall be April 1, 1985. Between the date of adoption of this resolution and April 1, 1985, the Managing Agent shall send violation notices without cost to the Association or unit owners, with a copy of this resolution and a notice of the April 1, 1985, effective date. Fees for waivers and orientations shall commence on the date of acceptance of this resolution.
