| 1. | Only mobile and operable passenger motor vehicles with current and validregistrations, license plates and inspection stickers may occupy any parkingareas within the common area. If a vehicle does not meet these requirements, the Managing Agent will place a dated notice on such an offending vehicle to the effect that it will be removed from the property in accordance with the towing policy outlined in this Resolution. | ||||||||||||||
| 2. | Each unit is entitled to a parking space in the common area parking lot. There is no assigned parking. Parking is on a first-come first-served basis. | ||||||||||||||
| 3. | No vehicle shall impede the free passage of any vehicle through the common area. | ||||||||||||||
| 4. | No vehicle shall impede any maintenance operations. | ||||||||||||||
| 5. | Repair costs for damage to common areas caused by vehicles, (i.e. leaking fluids, damaged landscaping, buildings, structures, etc.) shall be assessed to the owner of the unit where the owner of the vehicle causing said damages resides. | ||||||||||||||
| 6. | Motorcycles are required to utilize "kick-stand plates" to prevent damage to the pavement. | ||||||||||||||
| 7. | Off-road vehicles (i.e. snowmobiles, dirt bikes, ATV's, etc.) are prohibited from operation or use on the common property. | ||||||||||||||
| 8. | No commercial vehicles shall be allowed to be parked on the property. Commercials vehicles are defined to possess one or more of the following:

| 9. | All parking in lots next to buildings shall be ""Head-in" parking only | ||||||||||||||
| 10. | No parking is allowed in front of fire hydrants or in Fire Lanes. | ||||||||||||||
| 11. | No parking is allowed in front of the dumpsters as designated. | ||||||||||||||
| 12. | Only minor vehicle maintenance is allowed to be performed on the property. Minor vehicle maintenance is defined to include only the following repairs:

| 13. | Live parking (engine idling) only is allowed at the mailhouse for the sole purpose of drop-off and retrieval of mail. | ||||||||||||||
| 14. | Designated handicapped parking spaces may only be used by vehicles displaying handicap license plates or tags or for live parking (engine idling) to pick up or drop off persons with a handicap or disability. | ||||||||||||||
| 15. | Winter Parking Procedures:

| 16. | Recreational vehicles, boats, campers, and/or trailers shall only be allowed to be parked in the designated RV (Recreational Vehicle) lot by the Clubhouse. Use of the RV lot shall be as follows:

| 17. | Requests for exemptions or exceptions to any of the aforementioned rules must be made in writing to the Board of Directors and may only be granted by written consent of the Board of Directors. | ||||||||||||||
| 18. | Violation of any one or more of the previous sections of the VEHICLE AND PARKING RULES shall result in the Managing Agent assessing a fine of not less than $50.00 per occurrence. In addition, the Board of Directors or the Managing Agentcan charge the offending owner of the unit in which the violating vehicle(s) owner(s) resides with any costs incurred by the Association, due to the violation. | ||||||||||||||
| 19. | Furthermore, in addition to or in place of the above fine and cost assessments, the President of the Board of Directors may instruct the Managing Agent to have the violating vehicle towed from the premises at the owner's expense. The cost of the towing may average $150.00 for the tow and $25.00 per day that the towed vehicle remains on the towing company's lot before it's claimed. After the vehicle has been removed, the owner of the towed vehicle may contact the Managing Agent for information on where they mayretrieve their vehicle. | ||||||||||||||
| 20. | When applicable, any vehicle in violation of the Condominium Rules requiring removal from the property will be towed by any available registered towing operation. This company may be located as far away as Manchester, NH. All towing occurrences will be reported to the Nashua Police Department. | ||||||||||||||
| 21. | The Board may elect to seek legal and court-enforced assistance in an effort to resolve a condition of violation of this Policy Resolution. All costs and liabilities associated with ensuring compliance with this Resolution shall be assessed against the owner of the unit where the non-complying vehicle owner resides. | ||||||||||||||
| 22. | Failure by any owner who has received notice of violation of the aforementioned rules to pay an assessment penalty within thirty (30) days of the date of the penalty letter, shall result in: a lien being recorded on the owner's property, implementation of late payment penalties, legal fees, court fees and responsibility for any and all costs associated with the collection of said assessment penalty. |
The implementation of a penalty under this Resolution is subject to the receipt of a signed written complaint. The "Due Process" review procedures outlined in Policy Resolution IV shall apply to this Resolution.
This policy replaces and supercedes Administrative Resolution #9 and all other rules, regulations, policies or procedures with regard to vehicles and parking previously in force and/or adopted.
