CONDOMINIUM RULES

These Condominium Rules are adopted for the benefit of owners of residences in the Condominium project known as "Partridge Berry Hills Condominium." They are intended to contribute to preserving the clean and attractive environment and to ensure the peaceful enjoyment of the Partridge Berry Hills Condominium. They are also intended to protect and enhance the value of the owner's property in the project. They are not designed to unduly restrict or burden the use of the property.

All residents of Partridge Berry Hills Condominium and their guests are expected to abide by these Rules, which are meant to supplement the provisions of the Declaration and Bylaws.

1.

ADDITIONS TO EXTERIOR OF BUILDING. Changes affecting the appearance of the exterior of the building, such as decorations, awnings, television and radio antennas, signs, screens, sun shades, fans, or other changes are to be made only with the consent of the Board of Directors of the Partridge Berry Hills Association (the Board).

2.

HANGING OF CLOTHES, ETC. No clothes, linens, or other materials shall be hung or shaken from windows, placed on window sills, hung or draped from a balcony or railing, or otherwise left or placed in such way as to be exposed to public view. Outdoor clotheslines or other outdoor clothes drying or airing facilities are not permitted.

3.

NOISE. Owners, guests, and lessees will be expected to reduce noise levels after 10.00 P.M., so that neighbors are not disturbed. At no time are musical instruments, radios, or television sets to be so loud as to become a nuisance.

4.

MAINTENANCE OF LIMITED COMMON AREA. Owners will be responsible to keep their balconies and patios in a clean and sanitary condition, but the Board is responsible for their repair and maintenance resulting from reasonable usage which is to be treated as a common expense item.

5.

LITTERING. There will be no littering. Paper, cans, bottles, cigarette butts, foods and other trash are to be deposited only in appropriate trash containers, and under no circumstances are such items to be dropped or left on the grounds or other common areas.

6.

TRASH, REFUSE AND GARBAGE. No one shall place trash or other refuse in the common areas, except in containers or depositories designated.

7.

OUTDOOR EQUIPMENT. Bicycles, sporting goods, toys, baby carriages and other personal articles and equipment must be kept within the unit.

8.

MAINTENANCE OF COMMON AREAS. Improvements, maintenance and landscaping of the common areas shall be performed only by the Board.

9.

IMPROPER USE OF COMMON AREAS. There shall be no use of the common areas which injures or scars the common area or the plantings thereon, increases the maintenance thereof, or causes unreasonable embarrassment, disturbance or annoyance to other owners in their enjoyment of the same.

10.

OUTSIDE ACTIVITIES. There shall be no organized sports activities, picnicking or fires, except in areas approved by the Board. A charcoal fire in a protected metal barbecue container may be used in places approved by the Board providing it is carefully guarded and not hazardous to buildings or other property.

11.

PLANTING OF FLOWERS. Owners shall be permitted to plant flowers in areas approved by the Board. Such plantings shall be at the owner's expense and subject to standards as to location, use and maintenance established by the Board from time to time.

12.

HOUSEHOLD PETS. Household pets will be allowed, pursuant to the Declaration, only with the consent of the Board. If pets create noise, are allowed to run loose without supervision in the common areas, or n any way create a disturbance or unpleasantness, the Board will be forced to withdraw its consent in which case the pet must be removed. Each owner will hold the Board harmless against loss or liability for any actions of his pets within the community.

13.

PARKING SPACES. Each unit is entitled to one parking space in the parking areas on the premises.

14.

SPEED LIMIT. The speed limit for all vehicles within the community is 10 MPH.

15.

OFFENSIVE ACTIVITIES. No offensive activities shall be carried on in the Partridge Berry Hills Condominium nor shall anything be done or placed within the community which may be a nuisance, create unpleasant odors, or cause unreasonable embarrassment, disturbance, or annoyance to other unit owners or the general public.

16.

CHILDREN AND GUESTS. Owners shall be held responsible for the actions of their children and guests. If occupancy by guests creates a nuisance to other owners, the Board shall have the right to require that the offensive guest leave.

17.

ACTION IN VIOLATION OF LAW, ETC. There shall be no use of or activity in any unit or common area which shall be in violation of any governmental law, ordinance, rule or regulation.

18.

PASSKEY. The Board may retain a duplicate key to each unit. No owner may alter any lock or install a new lock on any door leading intothe unit of such owner without the prior consent of the Board. If such consent is given, the owner shall provide the Board with a new duplicate key for its use. It is not intended that an owner's privacy be intruded upon, and such keys shall not be used except in an emergency.

19.

CONSENT REVOCABLE. Any consent or approval of the Board or Manager given under these rules shall be revocable at any time.

20.

COMPLAINTS. Complaints of violations of these rules should be made in writing to the Board. If the Board feels that the complaint is justified, it will take whatever action it deems necessary. The complainant will be notified in writing by the Board as to what action has been taken.

21.

AMENDMENT. These condominium rules may be revised in any way at any time by the Board as conditions warrant, provided that a written communication is sent to each owner advising him of the change.

22.

DELEGATION OF POWER. The Board, in its discretion, may delegate its powers and duties with respect to the granting of consents, approvals and permissions under these rules, to the manager or managing agent, if any, of the Partridge Berry Hills Condominium.

23.

PATIO USAGE. The only items that may be kept on the patio are porch furniture, approved barbecue equipment and plants. Carpets and other forms of area covering are permitted only on concrete patios.

24.

Additional Rules have been adopted by the Board of Directors, such as pool, parking and pets, are inclosed herein.

POOL RULES

1.

The pool is for the exclusive use of owners, residents and their guests. One guest is allowed for each individual at the pool. Additional guests may be permitted by the monitor or management if the pool is not crowded, and the monitor may ask large groups to leave.

2.

The pool is open from 8:00 A.M. until 9:30 P.M.

3.

The pool/clubhouse monitor, when on duty, is not a lifeguard, but is responsible, with management, for enforcing all rules and has authority of the Board to remove individuals from the pool area and recommend revocation of use for continued flagrant violations.

4.

All children under 16 must be accompanied by an adult.

5.

Running, rough play in or out of the pool, excessive splashing, and improper use is dangerous and must be avoided.

6.

Food, glass, breakable items and pets are a health and safety problem and should not be brought into the pool area. Please use ashtrays, and place all trash in containers.

7.

Individuals with long hair must wear a bathing cap; loose hair cannot be backwashed from filter.

8.

Loud radios are not permitted at the pool.

9.

For the protection of all concerned, persons with skin rashes, skin ailments, nasal or ear discharges or colds, or any communicable disease, are forbidden to enter the pool.

10.

Cut-offs or dungarees are not permitted in the pool. Loose strands clog filters. Proper attire is bathing suits.

11.

Babies who are not toilet trained are not allowed in the pool, unless in diapers and rubber pants.

12.

All permitted individuals must have identification proving their residency in their possession in the pool area. Lack of an ID is cause for removal.

13.

Everyone must register when arriving at the pool and sign out when leaving. This will serve as a factual source of information as to the time and days when the pool is used, who is using it, and forecasts any congestion problems, and for safety.

14.

Owners, residents, and guests use the pool at their own risk.

15.
